Measures for soil environmental management in agricultural land
Chapter I General rules
The first article is to strengthen the supervision and administration of soil environmental protection in agricultural land, protect the soil environment of agricultural land, control the risk of soil environment in agricultural land, and guarantee the quality and safety of agricultural products. According to the law of the People's Republic of China environmental protection law, the law of the quality and safety of agricultural products in People's Republic of China and the prevention and control of soil pollution The plan of action shall be formulated.
The second agricultural land pollution prevention and control activities and their supervision and management are applicable to these measures.
The activities related to the prevention and control of soil pollution in agricultural land referred to in the preceding paragraph refer to the activities such as the prevention of soil pollution, the investigation of soil pollution, environmental monitoring, the classification of environmental quality categories and the classification and management of agricultural land.
The classification and classification management of soil environmental quality in agricultural land mainly refers to cultivated land. The garden, grassland and woodland may be referred to this method.
The third Department of environmental protection carries out unified supervision and management of soil environmental protection work for agricultural land throughout the country; the Department in charge of local environmental protection at or above the county level implements unified supervision and management of the activities related to the prevention and control of soil pollution in agricultural land in the administrative region.
The Ministry of agriculture has carried out supervision and management of the work on the safety utilization of soil, strict control, control and remediation of agricultural land in China, and the local agricultural departments at or above the county level are responsible for the organization and implementation of soil safety, strict control, control and rehabilitation in the agricultural land in the administrative region.
The prevention of soil pollution, the survey of soil pollution, environmental monitoring, classification of environmental quality categories, soil priority protection and supervision and management of agricultural land are organized and implemented by the environmental protection and agricultural departments at or above the county level in accordance with the relevant provisions of the present measures.
Article 4 The Ministry of Environmental Protection, in conjunction with the Ministry of Agriculture, shall formulate technical specifications for the investigation of soil pollution on agricultural land, environmental monitoring and classification of environmental quality.
The Ministry of Agriculture, in conjunction with the Ministry of Environmental Protection, has formulated technical specifications for the safe use of agricultural land, strict control, treatment and restoration, and evaluation of the effects of treatment and restoration.
Fifth local environmental protection and agricultural departments at or above the county level should include the contents of the prevention and control of soil pollution in agricultural land in the preparation of the environmental protection plan and the agricultural development plan of the administrative region.
The Sixth Department of environmental protection, together with the Ministry of agriculture and other departments, organized the national soil environmental management information system for agricultural land (hereinafter referred to as the agricultural land environmental information system) to carry out information sharing.
In accordance with the relevant provisions of the state, the competent departments for environmental protection and the competent agricultural departments at or above the county level shall organize the construction and application of the environmental information system for agricultural land within the administrative region, strengthen the statistical work on the soil environmental information of agricultural land, improve the information files on the soil environment of agricultural land, and regularly upload the Environmental Information Department of agricultural land. It implements information sharing.
The seventh specialized agencies engaged in the activities related to the prevention and control of soil pollution in agricultural land, and the third party institutions entrusted with the evaluation of the effect of treatment and restoration, should abide by the relevant environmental protection standards and technical specifications, and be responsible for the authenticity, accuracy and integrity of the technical documents issued by them.
The professional institutions entrusted with governance and repair shall abide by the state standards for environmental protection and technical specifications, carry out work within the scope of the contract, and be responsible for the management and restoration activities and their effects.
In addition to accepting penalties in accordance with the relevant laws and regulations, the professional institutions entrusted with governance and rehabilitation are liable for environmental pollution and ecological damage in the management and restoration activities, and should also be jointly and severally liable to other responsible persons responsible for environmental pollution and ecological damage in accordance with the relevant laws and regulations.
The second chapter prevention of soil pollution
Eighth enterprises and institutions that discharge pollutants and other producers and operators should take effective measures to ensure that waste water, waste gas discharge and solid waste disposal and disposal are in conformity with the relevant state regulations and requirements, and prevent the soil pollution of the surrounding agricultural land.
Enterprises engaged in the storage, transportation and disposal of solid wastes and chemicals shall take measures to prevent the leakage, leakage, sprinkling and dispersal of the agricultural land of solid waste and chemicals.
Ninth departments in charge of environmental protection at or above the county level should strengthen the supervision of the sewage discharge behavior of enterprises and institutions and other producers, and take the prevention and control of soil pollution as an important content of environmental law enforcement.
In accordance with the distribution and pollution discharge of industrial and mining enterprises in the administrative region, the local environmental protection authorities above the municipal level shall determine the list of the key supervision enterprises of the soil environment, upload the agricultural land environmental information system, carry out dynamic updates, and publish it to the society.
Tenth units and individuals engaged in large-scale livestock and poultry farming and processing of agricultural products shall, in accordance with the requirements of relevant regulations, determine the disposal methods for the harmless waste and the disposal sites.
The competent departments in charge of environmental protection at or above the county level and the competent agricultural departments shall strengthen the prevention and control of livestock and poultry pollution in accordance with their legal duties, guide the comprehensive utilization of livestock and poultry waste, and prevent the pollution of the soil environment of agricultural land.
Article 11 Local competent agricultural departments at or above the county level shall strengthen the publicity of knowledge on the prevention and control of soil pollution on agricultural land and improve the agricultural land soils of agricultural producers.
